It is also possible that upon dismissal, the right to redo or restart proceedings in the proper forum is lost. Accordingly, choosing the proper forum is imperative. With other cases, such as commercial tenancy disputes, the issues are beyond the jurisdiction of the Landlord Tenant Board and must be pursued in the Small Claims Court (or higher court) depending on circumstances and the legal issues involved and whether the matter involves less than the $35,000 per Plaintiff limit.
